Albin Yates Balius Roach, Attorneys at Law

Advancing Integrity. Preserving Truth.

Here for you, here to help.

I can honestly recommend Erin as THE lawyer to work with. I have worked with attorneys in several areas of law, from corporate to malpractice to family, and I can honestly say Erin is the smartest, the most organized, the most sympathetic and the most aggressive attorney I have ever met. She is extremely easy to talk with, is willing to answer the dumbest of questions with patience and yet is a bulldog in the courtroom. My husband’s custody battle was difficult with an ex that was unreasonable and used the court system to her advantage. Up until we hired Erin, we had spent thousands of dollars and years being taken to court for frivolous reasons with no end to the ridiculousness in sight. Erin was able to, within 18 months, end it. Rather than telling us “how it is”, she listened to what happened previously, the strategies that had been used against us, how the law worked for or against us and what strategy she would recommend. In the most difficult court room, in a court known to favor moms, Erin managed to not only encourage the court to see what was going on, she managed to persuade the court to grant all my husband’s request.

Child Custody: Care and Concern for the Child’s Best Interests

Divorce is an emotionally draining experience for adults. It is worse for children. Why is that? In most cases, it is because one or both spouses are so angry at each other or hurt by the situation that their parenting abilities are diminished – they can no longer think clearly about the situation and they wind up making choices that put their children squarely in the middle.

Albin Roach believes strongly in resolving child custody matters in a dignified manner that removes the children from the center of the conflict and instead puts their best interests squarely at the heart of the decision-making process. In other words, if you are considering divorce and are worried about the issue of child custody, our attorneys can provide the legal experience, expertise, and objective perspective needed to enable you to remain focused on resolving the conflict in a way that best protects your children.

Child Custody Laws and Options In Texas

The legal term used to describe what most people think of as child custody is actually called “conservatorship.” In a divorce, the basic presumption is that both parents will serve as “joint managing conservators” of the children. Despite how that sounds, this does not necessarily mean equal time or decision-making authority for both parents.  For instance, both parents cannot serve as the primary residential parent. One or the other normally has to be chosen. In addition, issues such as parenting time, grandparents, allegations of abuse and child support can complicate the situation further.

Our Frisco and Plano child custody attorneys bring a thoughtful, practical perspective to custody disputes. In representing you, we will take the time to understand your unique situation and goals. We will explain the various methods we can use to resolve the matter. And we will, whenever possible, work to reach a satisfactory child custody agreement without you having to go to court for a contested final trial. However, if litigation is necessary in your case you can depend on the family law attorneys of Albin Roach to advocate vigorously on your behalf and on behalf of your children.
